The man, from Bangladesh, claimed that in his culture he should be able to have sex with his wife whenever he pleases.
However, a judge ruled that the two should be separated as it is not her duty to "submit" to him.
His wife, identified only as TB, suffers with mental health issues, the court heard.
The 39-year-old is said to have the mental age of a child and therefore lacks the understanding to refuse sex with her husband of 18 years.
She was taken into care under the Mental Health Act by the London Borough of Tower Hamlets, where the family lived.
But her husband, known as SA, has since demanded that she return to their home.
Family Division judge Mr Justice Mostyn refused the claim.
He ruled that she would not be able consent to sex and should be detained in accommodation where she will receive 24-hour care.
He said: "Indeed the attitude of SA, based, as he told me on his culture and religion, was that he had a right to seek sex from her and that it was her duty to submit.
"The evidence clearly shows that TB has barely an inkling of the health risks involved. She was unable to link sex to pregnancy. Indeed she had virtually no idea how her babies came to be in her tummy (as she put it).
"Although she found sex enjoyable and comfortable she had no idea that she had a choice and could refuse."
It emerged that the couple had a "volatile" relationship and there were instances of domestic violence when the husband lost his temper.
Their four kids were also taken into care during the whole ordeal.
While making his decision, the judge said it would be "heartless" of the husband to make her pregnant again knowing the child would be taken away at birth.
The judge said: "Sex is a, if not the, basic animal instinct. It is a very powerful instinct. Without it animal (or any) life would not exist.
"Although it is a powerful instinct it still requires a positive choice and society demands that that choice is freely exercised by both parties."
